When you're weighing a settlement offer, risk analysis is very important factor of determining what action you should take. Different people bear risk differently. Some people are the riverboat gambler type mentality where they'll sustain a high level of risk, whereas other people are more conservative and they don't want any risk. When you're negotiating, there comes a point where one party will stop and say, "I'm willing to do no more, this is my best offer." When you reach that point, risk analysis is essentially determining what's gonna happen if I reject this offer. It may still be a bad offer. Maybe the risk is worth taking. It may be a very generous offer and you've gone beyond the level of risk that a reasonable person would bear, and again, that is where dealing with your attorney who has experience in these sorts of situations becomes very helpful to a client.
